Terms of Service
By creating an account or using Argus Vision Hub or any other Argus Logix service, website or application that links to these Terms (the "Service"), you agree to these Terms on behalf of the business you represent ("you"). If you do not agree, do not use the Service.
1. The Service
The Service is a software platform on which businesses in the logistics chain record and share logistics information. Except as provided in a separate agreement with Argus Logix, Argus Logix is not a party to any agreement between users, and fees, charges and disputes between users are solely between those users.
2. Accounts
Accounts are for businesses. The account owner is responsible for all staff accounts it creates, for keeping credentials confidential, and for all activity under its accounts. You must provide accurate information and keep it current. You consent to conduct business and receive notices electronically.
3. Your Data
You own the data you enter. You grant Argus Logix a license to store, process and display it as needed to operate the Service. You are responsible for the accuracy and legality of your data and for having the right to share it with the other users you work with. Records may be retained as needed to preserve the integrity of the Service. Argus Logix may use data in aggregated or de-identified form that does not identify you or any individual.
4. Acceptable Use
You may not: use the Service unlawfully; access data you are not authorized to see; interfere with the Service or its security; reverse engineer, copy or resell the Service; or use automated means to extract data except through interfaces we provide.
5. Availability and Changes
The Service is provided as is. We may change, suspend or discontinue any part of it at any time. We do not guarantee uninterrupted or error-free operation.
6. Intellectual Property
The Service, including its software, design and content, belongs to Argus Logix. These Terms grant no rights to it except the right to use the Service as intended. Feedback you provide may be used without obligation to you.
7. Disclaimer
To the fullest extent permitted by law, Argus Logix disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Information on the Service is entered by users; we do not verify it.
8. Limitation of Liability
To the fullest extent permitted by law, Argus Logix is not liable for indirect, incidental, consequential, special or punitive damages, or for lost profits, revenue, data or goods. Our total liability for any claim relating to the Service is limited to the greater of the fees you paid to Argus Logix in the 12 months before the claim or USD 100.
9. Indemnity
You will defend and indemnify Argus Logix against claims arising from your data, your use of the Service, or your breach of these Terms.
10. Suspension and Termination
We may suspend or terminate your access at any time for breach of these Terms or to protect the Service or other users. Sections 3, 6–9 and 11 survive termination.
11. Governing Law
These Terms are governed by the laws of the State of Delaware, USA. Disputes will be resolved exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction.
12. Changes and Assignment
We may update these Terms by posting a new version. Continued use after the update is acceptance. Argus Logix may assign these Terms to an affiliate or successor.
